Administrative, Municipal and Public Law
We advise government bodies, tribunals, regulatory authorities, and societies on legislative interpretation, inspections, licensing, compliance, administrative orders, and administrative penalties. We also advise government offices on the administration of public systems and the procurement of goods and services.
We advise private clients in navigating interactions with municipalities, regional districts, regulatory authorities, and tribunals. We help them obtain permits, licenses, and approvals, and we help them comply with regulations and requirements of the local, provincial, and federal government. We give practical advice on risk, procedure, and strategy. When decisions are challenged, we have the experience to advocate effectively through negotiations, hearings, and court proceedings.
We routinely advise both public and private clients on privacy issues and access to information.
Regulation of consumer contracts
- We advise clients on regulatory compliance and consumer protection matters, including deceptive practices, disclosure obligations, contractual requirements, cancellations, and refund policies. Our experience spans a range of industries, including telecommunications, mortgage lending, credit reporting, credit cards, airlines, hospitality, ticket sales, and e-commerce.
Regulation of business practices
- We advise clients on regulatory matters involving licensing, inspections, compliance requirements, and administrative proceedings. Our experience includes assisting with allegations of regulatory breaches, hearings, enforcement actions, asset freezes, and collection matters. We also help organizations develop clear policies and procedures to manage regulatory obligations and reduce risk.
Judicial reviews
- We represent businesses, government bodies, and public organizations in judicial review proceedings. Our experience includes preparing applications, affidavits, the record of proceedings, and legal submissions, as well as appearing as counsel at hearings before the courts.
The petitioner asked the court to set aside a development permit issued by the City, and Ryan obtained an order from the court that an industrial company should be added as a party because its investments and operations were directly affected.
Rezoning applications and Indigenous land claims
- Ryan has given legal support and strategic input in a rezoning process and four-way negotiation with the municipal and provincial government and the First Nation over approvals and ownership of a proposed multi-building development.
Procurements
- We have drafted procurement documents and advised on risks, in Requests for Proposals (RFPs) and Negotiated Requests for Proposals (NRFPs). The services to be purchased have included information technology and equipment. We have also acted for unsuccessful businesses who have challenged the legality and fairness of the process.
Privacy and access to information
- We have written legal opinions and given guidance to public bodies and federal business on the scope of their obligations when giving access to records and when deciding on disclosure or use of certain personal information. We have also advised on the exemptions and exceptions under the legislation as well as the complaints process with the commissioner. FIPPA and PIPEDA are frequently dealt with.
